General terms and conditions of business
Please note: For the purchase of events in the online shop of Werdenfels-Tours, the additionally listed, extended general terms and conditions apply.
1. General, scope of the GTC
1.1 All deliveries and services are carried out exclusively on the basis of the following general terms and conditions (hereinafter "GTC") in the version valid at the time of the order.

1.3 Customers within the meaning of these terms and conditions can be both consumers and entrepreneurs (hereinafter “customer”). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneurs within the meaning of the terms and conditions are natural or legal persons or partnerships with legal capacity who, when concluding the contract with the seller, act in the exercise of their commercial or independent professional activity.
2. REGISTRATION AND CONCLUSION OF CONTRACT
2.1 With the written or verbal registration, the contractual partner, hereinafter referred to as the customer, makes a binding offer to conclude an event contract. With your order you submit a binding offer to us to conclude the contract with you. The contract is concluded when an order confirmation is sent by e-mail. This registration applies to group programs for the entire group and the claims arising from the booking. By registering, the customer accepts the general terms and conditions.
2.2 Once you have found the event you are looking for, you can view it in detail without obligation by clicking on the item photo or the item description. By clicking on the button [shopping cart] you can place the article in the shopping cart. You can view the contents of the shopping cart without obligation at any time by clicking on the [Shopping Cart] or [Checkout] button. You can remove the products from the shopping cart again by clicking on the red symbol for [Delete] and the green symbol for [Update]. If you want to buy the products in the shopping cart, click on the button [continue].
3. STORAGE OF THE TEXT OF THE CONTRACT
We save your order and the entered order data. We will send you an order confirmation with all order data by e-mail. You also have the option of printing out both the order and the General Terms and Conditions before sending the order to us.
4. RIGHT OF WITHDRAWAL FOR CONSUMERS

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.

6. PAYMENT
Payment for the service is made in advance of the event by PayPal, credit card, immediate transfer, Sepa direct debit mandate, or other payment options offered by the organizer.
As soon as the organizer has received the payment, an electronic invoice will be sent to the e-mail address provided by the customer.
7. SERVICES AND MODIFICATIONS
The scope of the contractual services results from the service description of the organizer. Subsidiary agreements require written confirmation from the organizer to the customer.
The omission of individual parts of the service does not entitle the holder to withhold the contract sum or to a partial deduction, provided that the reasons involved are for which the organizer is not responsible. If the organizer is responsible for the omission of individual services, he has the right to replace these services with other services. The organizer is obliged to inform the customer of this.
If necessary, the organizer will offer the customer a free rebooking, a free cancellation, or an equivalent service agreed by the organizer.
8. WITHDRAWAL BY THE CUSTOMER (STORNO)
The customer can withdraw up to 48 hours (2 days) before the start of the booked event. The decisive factor is the receipt of the declaration of withdrawal by the organizer within the specified period.
The withdrawal must be made in writing and confirmed by the organizer. If the customer withdraws from the contract or fails to keep an agreed appointment without previously withdrawing from the contract, the organizer can demand appropriate compensation. The organizer can calculate the damage specifically or, at his option, assert a flat-rate claim for compensation.
9. WITHDRAWAL AND TERMINATION BY WERDENFELS-TOURS
The organizer can withdraw from the contract in the following cases:
- if the minimum number of 3 (three) participants is not reached by 9:00 p.m. the day before
- in the event of force majeure
- in case of sudden illness or non-appearance of a tour guide
- if the customer or the participants of a group of the customer persistently disrupts the execution of the event, despite a warning, or if he behaves in breach of contract to such an extent that the immediate cancellation of the contract is justified.
- if the customer does not comply with the agreed contractual terms.
10. LIABILITY
Werdenfels-Tours is liable as the organizer for the conscientious preparation of the events, the correctness of the service description and the proper provision of the contractually agreed service.
Werdenfels-Tours is not liable for services that are mediated as third-party services from other service providers (e.g. tours from other providers, visits to the theatre, museum or exhibitions, train, bus or taxi rides, etc.).
In addition, no liability is assumed for accidents and damage to the customer.
11. OBLIGATION TO COOPERATE
The customer or the participants in a group of the customer are obliged to cooperate within the framework of the statutory provisions in the event of service disruptions, to avoid any damage or to keep it to a minimum. The customer or the participants in a group of the customer are particularly obliged to notify Werdenfels-Tours of any complaints immediately.
12. PRIVACY
The customer agrees that the data provided for the processing of the agreed service will continue to be used by the organizer for customer service. This data will not be passed on to third parties in accordance with the Federal Data Protection Act.
13. OTHER
13.1 If one or more provisions of these General Terms and Conditions are ineffective, the rest of the contract remains effective. Insofar as the provisions are ineffective, the content of the contract is based on the statutory provisions.
13.2 The contract language is German.
13.3 Online platform (OS platform) for out-of-court dispute resolution

14. JURISDICTION, JURISDICTION
14.1 German law applies.
14.2 For consumers, this choice of law only applies to the extent that it does not withdraw mandatory provisions of the law of the state in which they have their habitual residence.
14.3 For all disputes arising from the contractual relationship, if the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be our company headquarters in Garmisch-Partenkirchen
